Introduction

Welcome to the Bodoland Digital Learning Program (the “App”). These Terms and Conditions (“Terms”) govern your access to and use of the App. By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

Definitions

  • “App” refers to the Bodoland Digital Learning Program application, including all content, features, and services offered through the application.
  • “User,” “you,” and “your” refer to the person accessing or using the App.
  • “We,” “us,” and “our” refer to Bodoland Educational Authority, the entity that owns and operates the App.
  • “Content” refers to all educational materials, including but not limited to videos, audio files, documents, quizzes, interactive modules, cultural resources, language learning tools, and other materials available through the App.
  • “Service” refers to all features, functions, and capabilities offered through the App.

1. Account Registration

1.1 Account Creation

To access certain features of the App, you must create an account. When creating an account, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy. Users may be required to verify their identity or affiliation with educational institutions in the Bodoland region.

1.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We recommend using strong passwords and changing them periodically.

1.3 Account Types

The App offers two different types of accounts, including:

  • Admin accounts
  • Guest accounts

Each account type has different access levels and features. You agree to use only the account type
that accurately reflects your role.

1.4 Admin Conduct

When using the App, you agree not to:

  • Violate any applicable laws or regulations.
  • Infringe upon the intellectual property rights of others.
  • Share your account credentials with others or allow others to access your account.
  • Attempt to access, tamper with, or use non-public areas of the App or our computer systems.
  • Interfere with or disrupt the App or servers or networks connected to the App.
  • Circumvent, disable, or otherwise interfere with security-related features of the App.
  • Use the App for any illegal, harmful, or unauthorized purpose.
  • Upload or transmit viruses, malware, or other types of malicious code.
  • Collect or harvest user data without permission.
  • Use the App to send unsolicited communications, promotions, or advertisements.
  • Impersonate another person or entity or misrepresent your affiliation with a person or entity.
  • Post, upload, or share inappropriate, offensive, or culturally insensitive content.
  • Engage in bullying, harassment, or intimidation of other users.
  • Interfere with another user’s learning experience.
  • Use automated systems or software to extract data from the App (data scraping).

2. Educational Content

2.1 Intellectual Property

All Content available through the App is owned by us or our licensors and is protected by intellectual property laws. You may access and use the Content solely for personal, non-commercial, educational purposes in accordance with these Terms.

2.2 Content License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non transferable, non-sublicensable license to access and use the Content solely for personal, non commercial, educational purposes.

2.3 Prohibited Uses of Content

You agree not to:

  • Copy, modify, distribute, sell, rent, lease, or otherwise exploit the Content without our written permission.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Content.
  • Use the Content for any commercial purpose or in any way that harms us or our licensors.
  • Share your access to the Content with others or allow others to access the Content through your account.
  • Translate, reverse engineer, decompile, or disassemble any software or applications provided through the App.
  • Create derivative works based on the Content without express permission.
  • Use the Content in any manner that might suggest endorsement or affiliation with your personal activities, organizations, or views.

2.4 Cultural and Indigenous Content

The App may contain cultural and indigenous content specific to the Bodoland region. You agree to respect the cultural significance of this content and acknowledge that certain materials may have cultural sensitivities or restrictions on use beyond those specified in these Terms.

2.5 Educational Grants and Subsidies

The App may be subsidized in whole or in part for certain users through educational grants, government programs, or partnerships. Eligibility for such subsidies will be determined based on criteria set by the funding organizations.

2.6 Third-Party Services

The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any such third-party websites or services.

3. Integration with Educational Systems

The App may integrate with third-party educational systems, learning management systems, or assessment platforms. Your use of such integrated services is subject to the respective terms and policies of those services

4. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms. Upon termination, your right to use the App will immediately cease.

You may terminate your account at any time by following the instructions in the App or by contacting us. Upon account termination, certain information may be retained in accordance with our Privacy Policy and applicable laws.

5. Disclaimers

“As Is” and “As Available”

The App and all Content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not guarantee that the App will always be secure, error-free, or available at any particular time or location.

Educational Content Disclaimer

The educational Content provided through the App is for informational and learning purposes only. While we strive to provide accurate and up-to-date information, we make no warranties regarding the accuracy, completeness, or reliability of the Content.

6. No Academic Guarantees

We do not guarantee specific academic outcomes or improvements in academic performance as a result of using the App. Individual results may vary based on various factors, including but not limited to user engagement, prior knowledge, and learning environment.

7. Regional Adaptations

While the App is designed primarily for users in the Bodoland region, we make no guarantee that all Content will be culturally or linguistically optimized for all communities within the region.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the App.
  • Any conduct or content of any third party on the App.
  • Any unauthorized access to or use of our servers and/or any personal information stored therein.
  • Any interruption or cessation of transmission to or from the App.
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App.
  • Any connectivity issues, power outages, or device limitations that affect your ability to use the App.

9. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney fees and costs, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

10. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the “Last Updated” date. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

For significant changes, we may provide additional notice through the App interface or via email to registered users.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising in connection with these Terms specific to the Bodoland region shall consider applicable regional laws and customs.

12. Dispute Resolution

Any dispute arising from or relating to these Terms or your use of the App shall be resolved through:

  1. Informal Negotiations: We encourage you to contact us first to try to resolve any disputes informally.
  2. Mediation: If informal negotiations fail, the parties agree to mediate any dispute before resorting to arbitration or litigation.
  3. Arbitration: If mediation is unsuccessful, any dispute will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
  4. Regional Dispute Resolution: For disputes specific to the Bodoland region, parties may agree to utilize traditional dispute resolution mechanisms where appropriate and legally recognized.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

14, Language
These Terms may be available in multiple languages, including Bodo and other regional languages. In case of any discrepancy between translations, the English version shall prevail.

15. Accessibility

We are committed to making the App accessible to users with disabilities. If you encounter accessibility barriers, please contact us for assistance.

16. Feedback

We welcome your feedback on the App. By providing feedback, you grant us the right to use such feedback for any purpose without compensation to you.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.
